1. Acceptance of Terms
By accessing or using Prodnami ("the Service") you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all visitors, subscribers, and users of Prodnami.
2. Description of Service
Prodnami is a desktop software suite for music producers that includes BeatStars automation, Instagram/iMessage outreach, YouTube rendering and scheduling, Spotify artist discovery, producer CRM, and AI-personalized campaigns. The Service is provided as a subscription billed through Polar.sh.
3. Subscriptions & Billing
Subscriptions are billed on a monthly or annual basis. Your trial period (if applicable) converts to a paid subscription automatically unless you cancel before the trial ends. All billing is handled by Polar.sh. You authorize us to charge the payment method on file for each subscription period. Prices may change with 30 days' notice. Refunds are provided at our discretion; contact [email protected] within 7 days of a charge if you believe you were billed in error.
4. Cancellation
You may cancel your subscription at any time from your Polar.sh billing portal or by emailing [email protected]. Cancellation takes effect at the end of your current billing period — you retain access until then. We do not prorate partial months.
5. Acceptable Use
You agree to use Prodnami only for lawful purposes and in compliance with the terms of service of any third-party platforms (BeatStars, Instagram, YouTube, Spotify, etc.). You may not use Prodnami to send unsolicited bulk messages that violate applicable laws (CAN-SPAM, GDPR, etc.), to harass or threaten others, to scrape or harvest data for resale, or to reverse-engineer the software. Violations may result in immediate termination of your account without refund.
6. Third-Party Platforms
Prodnami integrates with third-party platforms. We are not responsible for changes to those platforms' APIs, rate limits, or terms that may affect functionality. We make no guarantee that any specific platform integration will remain available. No refund is owed if a third-party platform restricts or blocks automated access.
7. Intellectual Property
All software, designs, copy, and content on prodnami.com are owned by Prodnami and protected by copyright. Your subscription grants you a limited, non-transferable, non-exclusive license to use the software for your own music production business. You may not distribute, sublicense, or resell the software.
8. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranty of any kind. We do not warrant that the Service will be uninterrupted, error-free, or produce specific results for your business. Results vary by artist niche, content quality, and platform conditions. No income or sales are guaranteed.
9. Limitation of Liability
To the maximum extent permitted by law, Prodnami's total liability to you for any claim arising from use of the Service is limited to the amount you paid in the 3 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or lost data, even if we have been advised of the possibility of such damages.
10. Indemnification
You agree to indemnify and hold Prodnami harmless from any claims, damages, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party's rights.
11. Governing Law
These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration on an individual basis (not as a class action) in accordance with the rules of the American Arbitration Association.
12. Changes to Terms
We may update these Terms at any time. We will notify you of material changes by email or via a banner on the site. Your continued use of the Service after changes are posted constitutes acceptance of the new Terms.
